Wednesday’s
Supreme Court verdict that convicted MPs and MLAs will be disqualified from
their respective membership will have a lot of bearings in the Odisha politics
as many of State legislators are facing a number of criminal charges.
Although no elected MP or MLA in Odisha has
been convicted as yet, several cases are pending against many of them.
Except Dhenkanal Lok Sabha member Tathagata
Satpathy, who is two-time MP having defamation charges pending (as he is also
editor of an Odia daily), all 20 MPs and MLAs are facing more than one criminal
charge pending against them.
The analysis of the affidavits of the
candidates in 2004 Assembly election indicated that political parties opted for
candidates having less criminal background. As per the Association for
Democratic Reforms(ADR) report in 2004 Indian National Congress had 30
candidates with pending criminal charges out of total 136 contested, BJP had 19
out of 66, BJD had 22 out of 84 contested.
As per the report of the ADR, out of 1288
candidates who contested in 2009 Assembly election, 295 candidates had criminal
cases against them while serious criminal cases like murder, kidnapping and
extortion are pending against 191 candidates.
As stated by affidavits of 147 MLAs of the
Assembly, 48 MLAs — that is, 33 per cent — have criminal cases pending against
them. There are 11 Congress, 4 BJP and 27 BJD MLAs have pending criminal cases
against them. Out of there 48 MLAs with pending criminal cases 31 have pending
serious criminal cases against them. Party wise break up for MLAs with pending
serious criminal cases - 7 of INC, 3 of BJP, 18 of BJD and 2 MLAs belonging to
other parties.
While ruling BJD MLA of Pipili Pradeep
Maharathy has 29 cases pending against him, 23 against Sanakhemundi Congress
MLA Ramesh Chandra Jena, 17 against G Udyagiri BJP MLA Monoj Kumar Pradhan, 12
agaisnt Biramitrapur MLA (independent) Gorge Tirkey, 7 each against Bonai BJP
MLA Bhimsen Choudhury and BJD’s Nimapada MLA Sameer Ranjan Dash, five against
Polsara BJD MLA Niranjan Pradhan, three against Bijepur Congress MLA
Subal Sahu and Parjang BJD MLA Dr Nrushingha Sahu, and two each against
Anandpur BJD MLA Bhagirathy Sethy, Chandabali BJD MLA Bijaya Nayak, Kanabanjhi
Congress MLA Santosh Singh Saluja, Jatni BJD MLA Bibhuti Bhusan Balabantaray,
Brajarajnagar Congress MLA Anup Kumar Sai, Kamakhyanagar BJD MLA
Prafull Kumar Malick, Bhatali BJD MLA Sushanta Singh and Phulbani BJD MLA
Debendra Kahanr.
Similarly, Balangir BJD MP Kalikesh Narayan
Singh Deo has two criminal cases pending against him while one is pending
against Kalahandi Congress MP Bhakta Charan Das.
